About these Terms and Conditions
These terms and conditions apply to our use of any words, pictures, images, data, information or any other ‘user-generated content’ (“Content”) that you upload, post or share using third-party platforms including but not limited to Instagram©, Facebook© (Meta©), Pinterest©, YouTube©, Snapchat©, Twitter© and TikTok© (the “Third Party Platforms”) and which we use on our website www.babyliss.com, or in any BaByliss owned social media platforms (“BaByliss Media”). “BaByliss” in these terms refers to The Conair Group Limited, company registration number 1134488, registered address: Maplewood, Crockford Lane, Chineham, Basingstoke, RG24 8AL

Our Use of the Content
- From time to time, we, along with our authorised service providers, select Content in Third Party Platforms that we would like to use in BaByliss Media.
- The Content selected and used by us will be in accordance with these terms and conditions.
- In order to be a selected participating contributor, you must be aged 16 years or over and have access to a valid and genuine Third Party Platform account.
- It is not necessary to purchase anything from BaByliss in order to contribute Content to BaByliss Media.
- If BaByliss would like to use your Content in any BaByliss Media, you will be contacted via relevant Third Party Platform to ask for your consent to use your Content. BaByliss will ask you to reply to us with the hashtag “#YesBaByliss” if you agree to allow us to use your Content in BaByliss Media. Once you have given your consent to BaByliss in this way, you agree to be bound by these terms and conditions as well as the terms of use of any relevant Third Party Platform.
- You must respond directly to BaByliss within the same chat, thread or by private message using the hashtag “#YesBaByliss” in order to release the agreed Content to BaByliss. If BaByliss does not receive your response within 7 days from the date of contact you, BaByliss will assume that you do not consent to our use of your Content and your Content will not be used by BaByliss in any BaByliss Media.
- By consenting to allow BaByliss use of your Content, you:
- agree that BaByliss processes personal data related to you for the purpose of contributing Content to BaByliss Media and that you are informed that you can withdraw this consent at any time and have us delete your Content according to our Privacy policy;
- warrant that you have obtained the express consent of personal data related to other data subjects than you in case of use of their personal data in your Content, and that you have informed them that their personal data are processed by BaByliss for the purpose to contribute to Content to BaByliss Media and that they can withdraw their consent at any time and have us delete their Content according to our Privacy policy;
- confirm that the Content is your original creation and not copied from third parties;
- grant BaByliss a right to reproduce, record, adapt, use, publish and share your Content and your image on any BaByliss Media for an unlimited number of uses, in all forms and all media including by exploiting any performers rights you and other participants in Content may possess on a world-wide basis unless and until you withdraw your consent to use Content;
- irrevocably and unconditionally waive all moral rights to which you may be entitled under any legislation now existing or in future enacted in any part of the world in relation to the Content;
- grant BaByliss a non-exclusive, worldwide, transferable, royalty-free, irrevocable, perpetual right and licence without compensation to use your Content and your image as set out in these terms and conditions and associate it with the name or pseudonym under which you posted it;
- confirm that you have all the rights necessary to allow BaByliss to use your Content;
- confirm that the creation and use of your Content on BaByliss Media complies with all applicable laws and regulations;
- warrant that your Content does not infringe or otherwise violate the copyright, trademark, trade, privacy or other intellectual property or other rights of any third party and that your Content is free from viruses and other malware; and
- waive any moral rights you may have in your Content, such as any right you may have to be named as the author of the Content or to protect the integrity of your Content.
- You give BaByliss your permission to redesign, archive, reproduce, disseminate, display, publicly perform and/or replay and make publicly accessible, as well as to cut and edit, adapt and modify your Content or any part of it on BaByliss Media.
- If your Content is corrupted, inappropriate, illegible or otherwise not in accordance with these terms and conditions then BaByliss will not accept your Content.
- You accept that BaByliss may choose not to use your Content, or to remove your Content from any BaByliss Media at any time. You agree that you will not receive any payment or other remuneration if BaByliss use your Content in any BaByliss Media.
If you remove any of the Content you released to BaByliss from the Third Party Platform it was originally posted on, then it will be removed from the BaByliss Media only where your and our Third Party Platforms are linked, subject to reasonable delays for technical reasons. If your Content is used by BaByliss on Third Party Platforms which are not linked and as a result your Content is not automatically removed from the BaByliss Media, and you would no longer like your Content to be posted on the relevant BaByliss Media, then please contact our Customer Service team to notify BaByliss of your request.

We will endeavour to attend to all requests as promptly as possible. We reserve the right to make reasonable additional enquiries in response to your requests to ensure that you have the right to require material to be taken down but will only use any information you supply to us for the purposes of verification of your identity and exercise of your rights. - To the extent it is permitted by law to do so, BaByliss accept no liability for any damage, injury or loss suffered due to use of your Content. Nothing in this clause is intended to exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited by law.
- BaByliss will only use personal information supplied by you for the purposes of posting your Content, unless you provide your consent for BaByliss to use your personal information for any other agreed purpose.
- These terms are governed by English law and any disputes in relation to them are subject to the exclusive jurisdiction of the English courts.
